When a family member dies, Texas law provides for a few types of redress. The estate of the deceased may maintain what is called a survivorship case – meaning that the damages are those that would compensate the estate for what was taken away from it: lost wages that the deceased would have earned in life, medical bills before death, pain and suffering of the deceased before death. This claim is brought by someone on behalf of the estate and the damages go to the estate of the deceased. Certain close relatives (spouses, parents, children) have wrongful death damages of their own: loss of companionship, loss of financial support, their own mental anguish at the death of their close relative or husband/wife. If a worker dies from a workplace accident, and the company was a workers' compensation subscriber, the workers' heirs can bring claims for punitive damages, only.
